A Trust Fund Victims Can't Trust

Harris Jorgenson’s story

Fargo, North Dakota. Harris grew up in the neighborhood around the W.R. Grace plant in Minneapolis, MN. As a child, Harris played with the other children on the piles of asbestos outside of the plant, not knowing that one day it would be the cause of his death. At the age of 39, he was diagnosed with lung cancer. He lost his battle with cancer and passed away five years later.

Harris and his wife, Isabel, have three sons who were very young when he passed away. Harris enjoyed spending time in his garden and was a dedicated father who spent much time with his family.

How would the asbestos bailout bill hurt Harris’s family?

The Jorgenson’s case demonstrates that the tort system works for the victims of asbestos exposure. In addition, under the asbestos bailout bill, victims of neighborhood exposure to asbestos will have no recourse for compensation. Isabel and the children would not have been able to recover anything if they were seeking compensation under the trust fund.
