A Trust Fund Victims Can't Trust

Toby Joseph Brown’s story

Russell, Massachusetts. Toby was born October 30, 1950. He is 55 years old and married to his loving wife, Cynthia.

Toby was an employee of W.R. Grace, where he worked in the Zonolite Division as a general workman. Toby performed a variety of duties, such as furnace operations and cleaning. Toby was continuously exposed to asbestos during his employment at W.R. Grace.

W.R. Grace is currently under criminal indictment by the Department of Justice for poisoning its workers and other residents around its Vermiculite mine and processing plant in Libby, Montana, and covering up its wrongdoing.

As a result of his asbestos exposure, Toby currently suffers from asbestosis. He has large calcification areas in his lungs and his condition causes him to get severely winded. Prior to his diagnosis, Toby was an avid skier and softball enthusiast; he can no longer do either due to his current condition.

How would the asbestos bailout bill hurt Toby’s family?

Toby has not yet filed his case. The proposed asbestos bill would prohibit Toby’s case and they would be forced to begin the claims process again under the new asbestos trust fund.
