ERISA health plans continue to aggressively pursue reimbursement of medical payments made on behalf of injured persons.  As a result, personal injury lawyers must not only understand the intricacies of ERISA subrogation and reimbursement, but also defend and negotiate these claims effectively.  Despite the Supreme Court’s decision in Sereboff, important questions remain: What happens if the underlying tort recovery has been dissipated?  Does federal common law, or state law, provide viable defenses?  Should “appropriate equitable relief” take into account the “made-whole” rule or the common-fund doctrine?  Can your client raise equitable defenses, such as laches or unclean hands?

Medicare’s right to recovery is likewise a critical issue.  Medicare Set Asides, particularly in personal injury cases, have caused confusion among the trial bar.  Considerations include: What are Medicare’s subrogation rights?  Must the personal injury lawyer take Medicare’s interests into account when settling a case?  Is a Set Aside allocation required?  What is the lawyer’s potential liability to the government?
