Supreme Court's 'nerve center' test keeps drug case in state court
In one of the first cases to apply a recent Supreme Court decision defining a corporation’s principal place of business as its “nerve center,” a Pennsylvania district court has denied a pharmaceutical company’s request to remove a case to federal court. The ruling defied conventional wisdom that the Court's decision would make staying in state court more difficult for plaintiffs.
