Supreme Court hears arguments on preemption of vaccine injury claims
In oral arguments last week, attorneys for Wyeth, Inc., and for the parents of a child allegedly injured by one of its vaccines debated the meaning of ambiguous wording in the National Childhood Vaccine Injury Act, which set up the "vaccine court" system. The justices are considering whether the act preempts vaccine design defect claims.
