Trial court says Louisiana med-mal cap is unconstitutional
Louisiana’s medical malpractice damages cap violates the state constitution’s equal protection and adequate remedy guarantees, a state trial court has held. In its decision, the court cited a recent Louisiana appellate court opinion that struck the cap in suits against nurse practitioners.
