The plaintiffs alleged that Philip Morris had committed fraud by falsely marketing Merit cigarettes as “low tar,” even though the defendant knew that Merits delivered the same amount of tar as other cigarettes. The jury awarded $25 million in punitive damages. Schwarz v. Philip Morris USA, Inc.
