Case in Point

Jury finds lifelong tobacco addiction caused smoker’s lung cancer death

Suit alleged that the estate of a man who died of lung cancer after years of smoking was entitled to assert the Engle jury’s common liability findings. The plaintiff offered evidence that the tobacco companies concealed material information about the adverse effects of nicotine and smoking. Gafney v. R.J. Reynolds Tobacco Co.
