The Florida Supreme Court has ruled that its state law capping noneconomic damages in wrongful death cases violates the state constitution’s equal protection clause. Florida had passed the law to address an alleged medical malpractice insurance crisis, but the court found that such a crisis never materialized—and that the law is arbitrary and bears no rational relationship to its stated purpose.
