Federal court rejects arbitration in smartphone spying class actions

Companies cannot invoke mandatory arbitration clauses if they are not parties to the contract, a federal district court has held. After smartphone users sued phone manufacturers and Carrier IQ, Inc., a telecommunications software vendor, the defendants tried to force them to arbitrate their claims based on arbitration agreements between the consumers and their wireless carriers.
