Blackburn v. Shire US Inc., No. 20-12258 (Ala. filed Mar. 10, 2022) (duty to warn)

AAJ joined the Alabama Association for Justice’s amicus brief addressing the following question certified by the Eleventh Circuit to the Alabama Supreme Court: “Consistent with the learned intermediary doctrine, may a pharmaceutical company’s duty to warn include a duty to provide instructions about how to mitigate warned-of risks?”

On November 7, 2022, the 11th Circuit held in favor of an advanced-stage kidney disease patient seeking damages for Shire Pharmaceuticals’ failure to instruct doctors to monitor patients’ kidney function while using the company’s mesalamine drug, LIALDA.
