On January 30, 2023, the 3rd Circuit reversed the bankruptcy court’s rejection of claimants’ motion to dismiss Johnson & Johnson subsidiary LTL Management, LLC’s petition for bankruptcy, finding that LTL was not in financial distress and holding that the Chapter 11 petition was not filed in good faith. AAJ filed an amicus brief in support of claimants and reversal in a brief authored by Senior Associate General Counsel Jeffrey White on July 7, 2022.
