Ending the Illusion of Oversight in Aviation Litigation

Congress has repeatedly gone to great lengths to keep the National Transportation Safety Board (NTSB) detached from civil litigation by banning the introduction of probable cause determinations into evidence. The time has come for Congress to do the same for the Federal Aviation Administration (FAA).

Congress should pass legislation prohibiting the introduction of airworthiness certificates into trial as evidence of an aircraft’s airworthiness. The reauthorization of the Federal Aviation Act this term is the perfect backdrop for such legislation.
