Options in Fourth Amendment Cases

INTRODUCTION
In a classic scene from The Pink Panther Strikes Again, Inspector Clouseau (Peter Sellers) is checking into a hotel. He sees a dog lying on the floor and asks the hotel clerk, “Does your dog bite”? The hotel clerk responds, “No,” so Clouseau bends down to pet the dog and says, “Nice doggy.” The dog viciously jumps up and bites Clouseau on the hand. Clouseau turns to the hotel clerk in bewilderment and says, “I thought you said your dog does not bite.” The hotel clerk responds, “That is not my dog.”

There is a lesson here for handling a Fourth Amendment “wrong dwelling” case. At first blush, the case might look like a “nice doggy,” but it may ultimately bite you.
