Late diagnosis, treatment of epidural abscess

September/October 2021

Doe, 54, was admitted to a Chicago-area hospital, complaining of abdominal and back pain. She subsequently experienced neurological symptoms, including progressive paralysis in her lower extremity and bowel and bladder incontinence. Four days into her admission, she was transferred to another hospital, where she was diagnosed as having a spinal epidural abscess. She underwent emergency surgery to drain the abscess; however, she suffered permanent injuries that left her incontinent and limit her ability to ambulate.

Doe sued the first hospital, alleging failure to timely diagnose and treat the abscess. The plaintiff did not claim lost income.

The parties settled for $4.5 million.
