Failure to heed traffic signal

June 6, 2019

As Doe, 27, was driving her Prius through an intersection, she was T-boned by a rental car driven by Michael Smith, who was in the course of his employment for EDF Renewable Energy. Doe suffered a traumatic brain injury in the collision, which has left her with severe cognitive and neuropsychological deficits that prevent her from continuing her graduate work.

Doe sued Smith and EDF Renewable Energy, alleging that Smith had run a red light at the intersection. The defense stipulated as to liability before trial but disputed the extent of the plaintiff’s injuries.

The parties settled for $400,000.

Citation: Doe v. Smith, Undisclosed Dkt. No. (Cal. Super. Ct. San Diego Cnty. Nov. 28, 2018).
