Improper lookout in strip mall parking lot

Scott Hutto, 43, was walking to his car in a strip mall parking lot. As he crossed a traffic lane, he was struck from behind by Jacquelin Porter, who had just turned her car into the lot. Hutto, who fell to the ground, suffered bilateral torn rotator cuffs and sprains to his lower back and right hip. He underwent physical therapy and missed approximately six months from his job as a mechanic. He was not able to return to that position and earned a reduced income for several years after the accident. His medical expenses totaled approximately $32,000.

Hutto sued Porter, alleging improper lookout. The defendant argued that Hutto had not paid proper attention to approaching traffic.

The jury awarded $475,000, finding Hutto 40% at fault.
