Inadequate lighting in movie theater

Tanaine Jenkins, who was in her late 30s, went with a friend to a movie at an AMC Entertainment theater. When the movie ended, Jenkins waited approximately 15 minutes before leaving the theater. As she walked down the carpeted steps, she fell, injuring her shoulder. She underwent shoulder surgery and incurred medical expenses exceeding $115,300.

Jenkins sued AMC Entertainment, alleging it had negligently turned off the overhead and stair lights after the film, creating a dangerous condition for patrons descending the stairway. Suit did not claim lost income.

The defense argued that Jenkins should have requested assistance or used the light on her or her friend’s cell phone.

The jury awarded approximately $482,400, finding the plaintiff 40 percent at fault.
