Alliance Brentwood, L.P., retained Modern Architectural, Inc., and Mai Lab, Inc., to provide architectural and interior design services for a new Los Angeles steakhouse. The project suffered significant problems, delaying the restaurant’s opening by approximately six to eight months.

Alliance Brentwood sued Modern Architectural, alleging breach of contract and negligence. The plaintiff asserted that Modern Architectural negligently performed its design services; failed to conform to plans and specifications, including for the restaurant’s kitchen; provided deficient designs for the restaurant’s plumbing, lighting, and acoustics; and failed to provide timely services. Suit against Mai Lab alleged it defectively manufactured, designed, constructed, and installed various furnishings, including bar stools, credenzas, lighting, and tables and chairs.

The parties agreed to a stipulated judgment of approximately $250,100 before trial. Modern Architecture paid $250,000, and Mai Lab paid the remainder.

Citation: Alliance Brentwood LP v. Mai Lab, Inc., No. SC124024 (Cal. Super. Ct. Los Angeles Cnty. Apr. 11, 2019).

Plaintiff counsel: Behzad Nahai and Jeffrey Lewiston, both of Los Angeles.
