The corporatization of many aspects of the recreational tourism industry has led to lower prices, more access, and increased popularity. As a result, recreational injuries at ski areas and resorts are on the rise. For example, more than 40 people die every year skiing and snowboarding and there are approximately 135,000 medically significant snow sports injuries every year in the United States. Ski resort accident cases present unique issues that are not often found in traditional tort or accident cases, including the applicability of waivers and releases of liability, per se statutory claims for liability under state law, heightened duties of care for recreational operators, statutory limitations on damages, the applicability of insurance coverage in cases involving co-participants, and defenses such as assumption of risk and inherent risk.

The Group hosts meetings at the AAJ Annual and Winter Conventions and provides tools and resources for members to successfully litigate their cases. Group members network and discuss legal issues and strategies on the Group's plaintiff-only list server and at regular meetings, including AAJ Conventions and Education seminars.
