Court Delays New Protections for Nursing Home Residents

Washington, DCThe following is a statement from American Association for Justice President Julie Braman Kane regarding a decision from the U.S. District Court for the Northern District of Mississippi to grant a preliminary injunction of a new regulation from the Centers for Medicare and Medicaid Services that will protect nursing home residents’ legal rights:

“Today’s decision temporarily delays the full implementation of the Centers for Medicare and Medicaid Services Reform of Requirements for Long-Term Care Facilities.

“We remain confident that CMS has clearly acted within its existing legal authority, and look forward to the full implementation of this rule, which ensures that nursing home residents retain access to the courts and that resident abuse is not left unchecked.”
