Failure to provide suitable wheelchair

November/December 2023

While a resident of Bristol House Memory Care, Anna Lounsberry, 95, slid out of a transport wheelchair and fractured her right femur. She underwent surgery, and she remained in a weakened condition until her death. She is survived by her three adult children.

Lounsberry’s estate sued Bristol House Memory Care, alleging claims for negligence, survival, and wrongful death. Among other things, suit alleged that the defendant had failed to supervise Lounsberry before her fall and provide her with a proper wheelchair suitable to long-term sitting and routine use.

The parties settled for $125,000.
