Negligent food and beverage wait staff

Phyllis Fulmer was admitted to Berkshire Center for rehabilitation. Approximately two weeks into her admission, a Berkshire Center employee allegedly spilled hot soup on her, causing bilateral burns to her thighs.

Fulmer’s estate sued owners and operators Genesis Healthcare LLC and 5501 Perkiomen Avenue Operations LLC, alleging their employee negligently spilled hot soup on Fulmer and failed to distribute warm food in a safe and reasonable manner. The plaintiff also claimed that the defendants hired unsafe food and beverage wait staff, failed to supervise them, and negligently trained them.

The parties settled for $90,000.
