Failure to inform patient of x-ray finding

Steven Rigler, 13, went to pediatric allergist Eric Glasofer, complaining of a headache, rhinitis, cough, and itchy eyes. Glasofer ordered a chest X-ray, which showed thoracolumbar scoliosis. Glasofer did not inform Rigler of his scoliosis and noted that the films were unremarkable. Approximately four years later, Rigler required spinal surgery to treat his condition.

Rigler filed suit against Glasofer, alleging failure to inform him of the chest X-ray findings and timely refer him for treatment of his scoliosis. Had he received an earlier diagnosis, the plaintiff asserted, he could have been treated conservatively.

The jury awarded $500,000.
