Transection of common bile duct
July/August 2024Doe, 45, underwent a laparoscopic cholecystectomy performed by Roe general surgeon, who had difficulty identifying Doe’s anatomy during the procedure. Two days after her discharge from the hospital, Doe went to an ER, complaining of increasing abdominal pain and excessive fluid from her surgical drain. Testing revealed an obstruction of her common bile duct. Subsequent exploratory and repair surgeries were successful.
She sued the general surgeon, alleging negligent failure to identify her anatomy before clipping and cutting her biliary tree structures and common bile duct.
The parties settled for $250,000.
