Failure to keep resident safe, medication overdose

September/October 2024

Lorraine Simms, a 79-year-old woman who suffered from dementia, hypertension, and diabetes, became a resident of Greenleaf Nursing and Convalescent. While there, she allegedly suffered at least seven falls, including while transferring from her wheelchair or going to the bathroom without assistance. After one fall, she was transferred to a hospital, where testing revealed a fractured right hip.

While hospitalized, she allegedly suffered a narcotics overdose, cardiac arrest, and shock. She was taken to intensive care and died several days later. Simms is survived by her four children.

Simms’s estate sued Greenleaf Nursing and Convalescent and the hospital, alleging medical negligence.

The parties reached a settlement for an undisclosed amount.
