Failure to timely treat post-ablation fistula
September 24, 2024In 2017, inmate Juan Flores was admitted to Bellevue Hospital Center on multiple occasions for treatment of chest pain and heart palpitations. Approximately two weeks after he underwent an ablation to treat atrial fibrillation, he was readmitted to the hospital, where he underwent computed tomography angiography. He then underwent multiple surgeries but died in the hospital two months later.
His estate sued the New York City Health and Hospitals Corporation, alleging that the defendant had failed to timely treat Flores for a life-threatening fistula between his esophagus and heart that resulted from the ablation. The plaintiff charged that the defendant should have timely returned Flores to the hospital when he experienced chest pain after the ablation.
The jury awarded over $6.3 million.
