Violation of New Jersey Residents' Rights Law

November/December 2019

Moody v. Voorhees Care & Rehab. Ctr., No. CAM-L-003643-16 (N.J. Super. Ct. Camden Cnty. May 30, 2019).

While a resident of the Voorhees Care and Rehabilitation Center for more than two years, Dorothy Moody, 84, developed extreme hyperglycemia, as well as dehydration, pressure ulcers, infection, and malnutrition— conditions that led to her hospitalization.

Moody, through her power of attorney, sued the nursing home, its operator, and others, alleging negligence and violation of the New Jersey Nursing Home Responsibilities and Residents’ Rights Act. The plaintiff argued that the defendants allowed her to be abused at the home, failed to hire a sufficient number of qualified and trained staff, failed to adhere to her care plan, and failed to maintain accurate medical records.

The jury awarded $225,000.

Judgment was entered for over $341,300, including interest and fees.
