Negligent Supervision of Probationer
August 2017Doe, 39, was walking near the University of Oregon football stadium when she noticed a stranger who seemed to be following her. The stranger caught up to Doe, knocked her to the ground, and dragged her into the bushes, where he beat and raped her. The attack caused Doe, who required hospital care, to suffer ongoing emotional distress.
Doe sued Washington County, Ore., which brought her alleged assailant—a juvenile probationer whose prior offenses included burglary, methamphetamine possession, and harassment—to an Oregon football game as part of a reward program for juvenile offenders under the county’s supervision. She alleged §1983 due process violations and negligent supervision. The plaintiff claimed that the defendant had brought the assailant to the game even though he had not complied with the terms of his probation. Suit also alleged that the defendant had not been adequately supervised while leaving the stadium, which allowed him to slip away from the group.
The parties settled for $666,700.
