Failure to yield to jogger in crosswalk

October 17, 2019

Ziyue Xia, an 18-year-old exchange student, was jogging on a path along a bridge near her school. She came to a street and entered a crosswalk on her way to a park. A vehicle operated by Sanford Becker struck and ran over Xia. She suffered a head laceration, subdural hematoma, and traumatic brain injury, necessitating a 13-day hospitalization. Xia continues to suffer from concentration and memory issues.

Xia sued Becker, alleging he failed to yield the right of way and negligently operated his vehicle. Suit did not claim medical expenses or lost income.

The defense countered that Becker failed to see Xia due, in part, to sun glare.

The parties settled for $1.4 million.

Citation: Xia v. Becker, No. MIDL3972-17 (N.J. Super. Ct. Middlesex Cnty. Mar. 28, 2019).

Plaintiff counsel: Nicholas Leonardis, Edison, N.J.
