Negligent use of portable generator

Lyle Powell, 72, was sitting in his son’s work van, which held a portable generator. While the generator ran with the van’s doors and windows closed, Powell suffered fatal carbon monoxide poisoning. He is survived by his two adult daughters.

Powell’s daughters, on behalf of his estate, sued the son’s business, 2RJP Ventures LLC, alleging vicarious liability for the incident. The plaintiffs asserted that because the company was in control of both the van and the generator, it was responsible for Powell’s death.

The jury awarded $1.39 million.
