State employee failed to yield right of way

Anthony Trapasso, 46, was driving through an intersection when the driver’s side of his SUV was struck head-on by Matthew Brown, who was driving a pickup truck in the course of his employment for the New Jersey treasury department. Trapasso suffered herniated disks at C4-5 and C6-7, which necessitated surgery. He was unable to return to his job as a truck driver.

Trapasso and his wife sued the state of New Jersey, alleging liability for Brown’s negligent driving. The plaintiffs alleged that the incident resulted from Brown’s failure to yield the right of way. Suit did not claim past medical expenses.

The court granted summary judgment for the plaintiffs on liability.

The parties settled for $500,000.
