Challenging the Ohio cap on noneconomic damages in child sex abuse case in which a jury returned a verdict for plaintiff, awarding $34 million in noneconomic damages and $100 million in punitive damages, which was reduced by the trial judge for noneconomic damages attributable to the period when the cap was in place to $250,000.

On December 29, 2022, the Supreme Court of Ohio lifted a significant limit to justice for survivor of child sex abuse in holding that the state’s statutory damages cap, as applied, violates state constitutional due process guarantees. AAJ filed an amicus brief in October 2021 to challenge the state’s compensatory-damages cap facially and as applied.
