Consumer Privacy/Data Breach
Data breach and privacy issues are of enormous interest to the public. The data breaches of Target, Neiman Marcus, Michaels and Adobe have affected millions of Americans. In 2013, Target announced that the debit and credit card information of 40 million people across the country had been compromised. Later, Target announced that up to 70 million more people had their personal information, such as mailing addresses, email addresses, and phone numbers stolen. To date, law firms across the country have filed more than 70 class action cases against Target.
There have also been many other privacy and data breach cases, such as privacy and data breach cases brought against Adobe, Yahoo, Sony, Gmail, and Facebook. Privacy and data breach cases often involve claims for negligence, breach of contract, and violations of various state and federal statutes, such as state data breach laws or state and federal privacy laws. Many cases also involve HIPAA, or various state statutes that are meant to protect the health information of patients. The cases involve common issues, such as what steps a company needs to take to reasonably protect the data of its users.
