Over-Designation Litigation Group

Defendants often designate documents as confidential when they are not and over-use privilege designations to shield non-confidential, non-privileged materials from disclosure. They use over-designation to hide important documents that may show fraud or safety risks and, when disclosed, to keep such documents under seal and out of public view through litigation and after settlement. Such abuse of the attorney-client and attorney work production privileges keep important documents from the public and from plaintiff attorneys. The Over-Designation Litigation Group provides the tools and expertise to make it easier for members to fight back against protective orders, privilege claims, and the over-designation of documents as confidential.

 

Group History

The Over-Designation Litigation Group was formed at the 2023 Spring Board of Governors meeting. Members have access to a Document library and list server. The Group meets at AAJ Annual and Winter Conventions and plans to host programs and meetings throughout the year.
