Failure to warn of known tire defects
September 8, 2020Daniel Miregi, 45, was operating a concrete mixing truck on a highway when the truck’s right front tire burst suddenly. Miregi lost control of the vehicle, struck a barrier, and plunged 60 feet off a bridge, suffering fatal injuries. Miregi is survived by his wife and six minor children. He had been earning approximately $80,000 annually.
Miregi’s estate sued Sailun Group Co., the tire’s manufacturer, alleging strict liability claims and failure to warn of known defects in the tire. Suit also named distributor TBC Brands, alleging that the company was legally responsible for Miregi’s death as the Chinese manufacturer’s U.S. representative. Finally, the plaintiff alleged that Alamo Concrete Products Co. and Dorsett Brothers Concrete Supply Inc. were liable for failing to maintain the tire.
The parties settled for an undisclosed amount.
