Defective design, manufacture of boom dolly

April 6, 2021

Marco Crane & Rigging Co. purchased a boom dolly from Greenfield Products, LLC. The boom dolly malfunctioned during use, causing the crane to which it was attached to turn over, resulting in damage.

Marco Crane sued Greenfield Products, alleging strict liability, negligence, and breach of warranty. Suit claimed that the boom dolly had been defectively designed and manufactured due to its insufficient welding and boom attach point design.

The defense argued that the plaintiff’s employee was the sole cause of the incident and that it had breached no express or implied warranties related to the product.

The jury awarded more than $734,900, finding the plaintiff 43% at fault.
