Lack of emergency shut off

Elizabeth Canales was cleaning a piece of machinery when it powered on unexpectedly. Her right hand became caught in the machinery, causing her severe injuries.

She sued VFK Head Corp., which designed, manufactured, and sold the machine, alleging strict liability and negligence. The plaintiff claimed that the defendant had designed a dangerous product and failed to provide proper instruction and training regarding its use and care. Suit also claimed that the machine lacked adequate guards and other safety mechanisms, including an emergency shut off.

The jury awarded more than $33 million, including approximately $785,100 for past medical expenses and approximately $190,000 in past lost income.
