Settlement for teen’s allergic reaction at restaurant
April/May 2022Doe, who suffered from a nut allergy, went to a restaurant with his mother and inquired whether food he was about to eat contained tree nuts. After eating the food, Doe, 15, suffered a severe allergic reaction, including hives and wheezing. He was treated at a hospital emergency room and required follow-up care. The experience caused Doe considerable emotional distress. His medical bills exceeded $6,200.
Doe sued the restaurant, alleging liability for serving him food containing tree nuts and for the resulting allergic reaction.
The parties settled for $85,000 shortly after suit was filed.
