Jury awards damages for smoker’s lung cancer death
August 2, 2022Raymond Wyerick smoked Pall Mall cigarettes. He developed lung cancer and died at age 57.
Wyerick’s wife, as personal representative of his estate, brought an Engle progeny suit against R.J. Reynolds Tobacco Co. The plaintiff asserted that Wyerick had been addicted to cigarettes and that this was the legal cause of his lung cancer and death.
The jury awarded $1 million, finding Wyerick 65% at fault.
