Settlement for child injured in IKEA dresser tipover incident
January 10, 2023Arling Sandoval was at home with her minor son, Jeremy, who was watching a television situated on top of an IKEA dresser. After Sandoval heard a crash coming from the other room, she entered the room to find Jeremy trapped under the dresser. The boy suffered unspecified injuries.
Jeremy and Sandoval, as his guardian ad litem, sued IKEA US, Inc., and others, alleging liability under the New Jersey Product Liability Act, N.J. Stat. Ann. §2A:58C-1 et seq. The plaintiffs claimed negligence, breach of implied warranty of merchantability, strict liability, and failure to warn and asserted that the dresser was not reasonably suited for its intended purpose.
The parties settled for $27,000.
