Failure to prevent resident’s fall

November/December 2020

Evelyne Eisenman suffered from dementia and lived at the South Elgin Rehabilitation & Health Care Center. During her 15-month stay at the facility, she suffered a fall, which resulted in a fractured left hip.

Her estate sued the home’s parent corporation, alleging failure to protect Eisenman from abuse and neglect, ensure that she was provided adequate assistance to prevent her from falling, and implement a proper care plan, among other things.

The parties settled for $150,000.
