Failure to secure wheelchair to van’s locking mechanism

November/December 2020

Doe, 80, used a wheelchair and resided in a nursing home. While transporting Doe to a doctor’s appointment, a driver for Roe medical transport company failed to secure her wheelchair into the van’s locking mechanism. When the driver stopped abruptly, Doe was thrown into the van’s console, suffering a fractured femur. She required open reduction and internal fixation surgery.

Doe claimed that the transport company’s driver had negligently failed to secure the wheelchair. The defense contended that the van’s lessor was liable for its defective locking mechanism.

The parties reached a settlement before suit was filed for $237,500.

Citation: Doe v. Roe, settled before filing, May 20, 2020.

Claimant counsel: AAJ member W. Randolph Robins Jr., Richmond, Va.
