Failure to prevent resident’s fall

While living at a nursing home, Selma Fuller, 85, fell and suffered a head injury. She died 12 days later and is survived by her three adult children.

Fuller’s estate sued several health care providers who provided treatment to her after the fall, alleging negligent treatment of the head injury. Suit against the nursing home and Indiana’s patient compensation fund alleged failure to prevent Fuller’s fall by, among other things, using a bed alarm.

The plaintiff settled confidentially with the health care providers. The nursing home and the patient compensation fund settled with the plaintiff for approximately $212,200.
