Failure to prevent pressure sores

September/October 2020

Doe, 89, was admitted to Roe nursing home after being hospitalized for apparent stroke symptoms. At the time of his admission, Doe suffered from dementia but had no skin breakdown. Over the next three months, however, Doe developed a pressure sore on his buttock and a Stage II pressure sore on his upper left thigh. He was diagnosed as having osteomyelitis early the following year and underwent a leg amputation, which led to sepsis and his death several months later. He is survived by his three adult daughters.

Suit claimed that the nursing home had failed to prevent and treat Doe’s pressure sores, including providing him with a special mattress and frequent turning, and failed to provide proper nutrition and hydration.

The defense reportedly argued that it had provided proper treatment.

The parties settled for $100,000 before suit was filed.
