Negligent delivery
September/October 2020During her delivery at a hospital, Destiny Coleman suffered a brachial plexus injury.
Her mother, individually and as her guardian, filed suit against the estate of Robert Lipari, the late obstetrician who had delivered Coleman, alleging medical negligence. The defense argued that Coleman’s injuries resulted from maternal forces of labor, contractions, and maternal pushing.
The parties structured a settlement for $365,000.
Citation: Coleman v. Lipari, No. 46928/09 (N.Y. Sup. Ct. Suffolk Cty. Jan. 14, 2020).
