Negligent performance of hysterectomy

September/October 2020

Doe underwent a laparoscopic hysterectomy performed by Roe OB-GYN and was discharged the same day. Doe contacted the physician’s office over the next few days, complaining that she felt ill and had pain. Four days after the surgery, Doe went to a hospital ER, where a CT scan showed an accumulation of fluid in her pelvis. Surgery revealed a hole in Doe’s sigmoid colon, necessitating a colostomy. She also was later diagnosed as having an injured right ureter. Doe required a colostomy bag and a nephrostomy bag for 10 months. She required surgery to treat several incisional hernias.

Doe filed suit against Roe, alleging medical negligence.

The plaintiff and defendant settled the case for $1 million during trial.
