Failure to implement fall prevention measures
December 21, 2021Josefa Rodriquez, who suffered from dementia, was admitted to the Majestic Oaks Rehabilitation and Nursing Center for a respite stay. It was noted when she was admitted that she required one or two people to assist her with activities of daily living. She suffered two falls at the facility and was diagnosed as having a fractured right hip. She received treatment at a hospital and was discharged home to receive home health care. She died approximately two months later and is survived by her husband and five children.
Her estate sued Majestic Oaks and its operator, alleging negligence, corporate negligence, wrongful death, and survival. The plaintiff asserted failure to implement fall prevention measures and properly supervise Rodriquez, among other claims.
The parties settled for $187,500.
