Negligent performance of hysterectomy leads to colostomy

January/February 2021

Doe, 63, underwent a hysterectomy performed by Roe physician. Almost three weeks after the procedure, Doe was admitted to a hospital, where testing revealed that she had a gangrenous cecum. She underwent two colectomy surgeries, was hospitalized for three weeks, and required a month of inpatient rehabilitation. She now suffers from chronic abdominal pain and is not a candidate for reversal of her colostomy. Additionally, she requires daily in-home assistance.

Doe sued Roe, alleging he negligently perforated her cecum during the hysterectomy. Suit did not claim lost income.

The defense argued that the perforation resulted from Doe’s preexisting Ogilvie’s syndrome.

The parties settled for $750,000.
