Failure to diagnose lung mass

Doe, 37, underwent radiologic imaging to investigate symptoms. Although a mass was not identified, Doe was later diagnosed as having metastatic cancer. Doe subsequently died of the cancer.

The claimant alleged medical negligence and wrongful death, asserting that health care providers had failed to diagnose a lung mass present on the radiologic imaging. Had Doe’s health care providers timely worked Doe up for the lung mass, the claimant argued, Doe would have undergone a bronchoscopy and biopsy, which would have led to timely cancer diagnosis and treatment. Alternatively, Doe could have undergone resection of a bronchogenic cyst, which would have prevented malignant transformation of the mass.

The parties settled for $2 million before suit was filed.
